Supreme Court rules against appraiser

TALLAHASSEE -- The Florida Supreme Court ruled Thursday that Hillsborough Property Appraiser Rob Turner can't go to court to challenge the constitutionality of laws he is sworn to uphold.
The court said Turner could not file a lawsuit to challenge an assessment of the New York Yankees minor league training complex on Himes Avenue. The decision means the Yankees won't have to pay more in 1997 taxes.
Turner filed a lawsuit in 1997 after a board that reviews property assessments overturned his evaluation of the Yankees facility. Turner had set the taxable value of the 15-acre complex at $5.7-million, but the board dropped the value to $700,000 -- and saved the Yankees about $125,000 in taxes.
Turner sued, saying the board based its decision on an unconstitutional state law. A circuit court judge dismissed Turner's lawsuit, saying he couldn't challenge the law. That's when Turner appealed.
