DADE CITY -- The question of what kind of home is allowed in a Darby area subdivision is heading back to court for the second time this week.

DADE CITY -- The question of what kind of home is allowed in a Darby area subdivision is heading back to court for the second time this week.

Homeowners are once again trying to keep a property owner from bringing a home they consider mobile into their deed-restricted neighborhood.

Palomino Lakes subdivision resident Larry Vinson argued in a case filed this month that property owner Harold Walldren of Tampa is forbidden from erecting anything but a site-built home on his 12-acre parcel.

The lawsuit cites homeowners association rules that were toughened in 2000 after another fight with a property owner over a manufactured home.

The amended deed restrictions specifically forbid anything but homes built on the property, according to Vinson.

Circuit Judge Maynard Swanson is scheduled to hear the first motions on the new lawsuit Wednesday afternoon.
