Miss N.C. suit moves to federal court

An ugly battle over which woman will walk on stage as Miss North Carolina later this month in the Miss America Pageant was moved to federal court Thursday.

A federal judge in Wilmington, N.C., was assigned the case after a state judge agreed he no longer had jurisdiction in the lawsuit filed against the national pageant by Rebekah Revels.

No new date has been set for a hearing, and time is becoming a factor with the pageant's contestants expected to participate in preliminary events starting today.

Revels, 24, won the state pageant in June, but she stepped down as Miss North Carolina in July after an ex-boyfriend claimed he had snapshots of her topless.

She sued the state pageant and won the title back in a ruling Wednesday.

In the interim, however, runnerup Misty Clymer had been named Miss North Carolina to replace Revels, and the Miss America Organization has said it recognizes Clymer as the true Miss North Carolina.

Both women have contracts with the Miss North Carolina organization, which is a franchise subsidiary of Miss America.

Times Square closed for NFL event

Forget parking lot barbecues. The NFL kicked off its season Thursday with what it called the "world's largest tailgate party," a concert in New York's Times Square featuring Bon Jovi, Eve, Alicia Keys, 'N Sync's Joey Fatone and Enrique Iglesias.

Thousands of people gathered in Times Square for the event, which came before the league's prime-time attraction: the New York Giants vs. the San Francisco 49ers at Giants Stadium.

Dozens of city blocks were closed, traffic was rerouted and about 5,700 police officers were deployed.

Times Square is usually shut down to traffic only on New Year's Eve, when upward of a million people jam the area to watch the ball drop.

Parts of the Times Square show were broadcast live on VH1. Tonight, CBS will air parts of the show at 10.

Gorilla Theatre cancels some performances

Gorilla Theatre canceled its season-opening performances of Bach Among the Flowers by the theater's co-founder Aubrey Hampton.

Shows Thursday, today, Saturday and Sunday were called off after Eric Davis, the actor playing the title role of Dr. Edward Bach, had an emergency appendectomy on Wednesday. The theater plans to reschedule the play next week.
