Judge: Alliance records not secretBy Times staff writer© St. Petersburg Times published January 30, 2003 A Leon County Circuit judge turned down a request by Alliance Capital Management to keep secret some documents related to its investment of state retirement funds in Enron Corp. stock. The Florida State Board of Administration is suing Alliance, blaming mismanagement by the company for more than $300-million in pension fund losses. Alliance said documents it is being asked to submit in the case contain trade secrets, which it should be allowed to keep confidential. The company wanted a procedure set up to review documents before they were made available to the public and an order requiring the Board of Administration to keep secret any documents turned over in relation to the lawsuit. The documents Alliance initially claimed were confidential included material such as newspaper articles. Circuit Judge Nikki Ann Clark turned down Alliance's requests. She said any claims Alliance wants to make about trade secrets will have to be dealt with one document at a time. She also said the board is a government agency and the trial involves official business, which makes trial documents in the board's possession public records.
