Family of man fatally shot sues defendant's employer

NEW PORT RICHEY -- The family of a man killed in what police say was a case of mistaken identity sued the owner of the Hudson motel that employed the man suspected of shooting him. Debra Ingalls, the mother of Todd Kammers, filed the wrongful death lawsuit Friday in circuit court against D & M Management Inc., the owners and operators of Coral Sands Motel in Hudson. Kammers, 26, was shot and killed at the motel on June 28, 2001. Police say hotel manager Gary Evers shot him numerous times, thinking he had been involved in a violent theft attempt the night before. Evers remains in the Pasco County jail in Land O'Lakes awaiting trial on charges of first-degree murder. Last year, Edwin Humphrey was convicted of armed burglary for the incident at the motel and sentenced to life in prison. He's facing more charges. The state has announced that it will seek the death penalty if Humphrey is convicted of murdering Robert Hay, 18, on June 27, 2001 in an unrelated incident. He is also awaiting trial on charges of carjacking and kidnapping a taxi driver. The lawsuit accuses D & M Management of negligence for failing to properly train and supervise Evers. Aside from pain and suffering, Kammers' daughter, Felisha Kammers, should be compensated for the economic support that she lost in her father's death, said the family's attorney, Guy Perenich of Clearwater. "How is this child going to fare in the future for all she needs?" he asked. No one could be reached at the motel or at D & M Management.
