Man held in abuse of disabled

CLEARWATER - A onetime nursing home worker was charged Monday with choking a disabled man who was under his care.

Victor A. Hernaiz, 50, was charged with abusing a disabled person. He was released from the Pinellas County Jail on Tuesday after posting $5,000 bail.

Clearwater police said Hernaiz was working at Harbourwood Nursing Center, 2855 Gulf-to-Bay Blvd., on April 2 and was caring for a 56-year-old disabled man who had suffered a stroke.

The man told police that Hernaiz woke him, then put his hands around his neck, began choking him and said "I will show you who is boss," arrest reports state.

The choking left the victim out of breath. He also suffered red marks on his neck, arrest reports state.

A company official said Hernaiz no longer works at Harbourwood Nursing Center.
