As Sandra Rozzo walked out into the parking lot at the Green Iguana on May 31 in Tampa's Rocky Point area, a rifle shot whizzed by, missing her.

Some distance away, investigators now say, , was Ashley C. Humphrey, bent on killing Rozzo, who was scheduled to testify in the felony battery trial of Humphrey's soon-to-be husband, Timothy Lee "Tracey" Humphrey.

Rozzo was killed in July, shot several times, and Ashley Humphrey was indicted in December on first-degree murder charges in Rozzo's death.

On Friday, Timothy Humphrey also was indicted. Police say he was behind the plan to kill Rozzo, 37, who died five days after the Humphreys were married.

Timothy Humphrey, 37, already in jail facing weapons charges, was indicted in Pinellas County on a charge of first-degree murder.

The Humphreys were arrested in December at their personal training business in Brandon. Ashley was immediately charged, and police suspected Timothy was involved but lacked evidence to charge him. Investigators from the Pinellas Park Police Department, Florida Department of Law Enforcement, Hillsborough County Sheriff's Office, Tampa Fire Department and Pinellas-Pasco State Attorney's Office uncovered a "detailed plan for the murder of Rozzo in an effort to hamper the prosecution of Tracey Humphrey," according to the FDLE.

Investigators say the May 31 shooting was part of the Humphreys' plan to kill Rozzo, though it failed.

The FDLE said investigators recovered evidence and weapons used in the attempt and the killing of Rozzo, evidence they say Timothy Humphrey tried to hide. He was being held without bail at the Hillsborough County Jail on Friday night.
