End to delay sought in Terri Schiavo case

Michael Schiavo asked two courts Tuesday to stop delaying the removal of a feeding tube keeping his wife alive.

In a flurry of court filings from both sides, Schiavo asked Pinellas Circuit Judge George Greer to reconsider a seven-week stay on the removal of Terri Schiavo's feeding tube. The stay was issued last week when Greer turned down requests from Terri Schiavo's parents for a new trial on whether she would want to live or die.

George Felos, Michael Schiavo's attorney, also asked the Florida Supreme Court to deny a request from Gov. Jeb Bush to issue a second stay that could keep Terri Schiavo alive while the U.S. Supreme Court is asked to take up the case. A hearing was set for today before Greer on the Dec. 6 stay. It was not clear when the Florida Supreme Court would rule on Bush's request.

Meanwhile, attorneys for Terri Schiavo's parents, Bob and Mary Schindler, appealed Greer's latest ruling denying a new trial in the case to the 2nd District Court of Appeal in Lakeland.

Her parents say Terri Schiavo was raised Catholic and would, if able, accept recent comments from Pope John Paul II that a person in a persistent vegetative state has the right to nutrition and to withhold it would be a sin.
