Worker sues hospital over sick leave

Oak Hill Hospital refused to pay sick time built up over 13 years, an employee's lawsuit says.

BROOKSVILLE - A Hernando County health care employee is suing her longtime employer, Oak Hill Hospital, for her sick time that she had accrued over 13 years with the company.

Carol Roy, 66, fractured her wrist and pelvis at home in December. But when she asked for sick pay to sustain her while she healed at home, the company refused, according to the lawsuit.

Roy had accrued 191 hours of sick leave, or about $2,500, as a sterilization technician, said her attorney Wolfgang Florin of Palm Harbor. She's on unpaid leave.

Oak Hill Hospital spokesman Richard Linkul said the company doesn't comment on litigation.

Roy said Oak Hill Hospital officials told her she couldn't take sick leave, because she is now a part-time employee. However, Roy argues that she earned the sick leave as a full-time employee and should be entitled to sick pay when she's sick.

"She's not asking for a penny more than she's earned," Florin said. "For whatever reason, they won't give it to a dedicated employee with almost 15 years (with the company)."

Roy is asking for a jury trial and compensatory damages.
