Franchise fees reinstated

BELLEAIR - Progress Energy Florida has the right to collect franchise fees from customers in Belleair even though the company's franchise agreement with the town has expired, the state Supreme Court ruled Thursday.

The decision effectively reaffirmed a previous ruling, but it struck down a decision by the 2nd District Court of Appeal that said the company could not collect those fees. Belleair has been exploring starting its own utility, and a referendum on the issue is scheduled by October. After the town refused to renew a franchise agreement that expired in December 2001, Progress Energy argued in court that it did not have the right to collect the fees. Town officials said the energy company owes the town more than $650,000 for about 28 months of uncollected fees.
