Company sues for right to build taller cell tower

INVERNESS - A company owned in part by state Rep. Charles Dean is suing the city to get permission to build a 30-foot extension on a cell phone tower on U.S. 41 S.
In December, Charlie Dean Inc. completed construction of a 164-foot metal tower at the southeast corner of Our Lady of Fatima Catholic Church's property. Now, the company wants to make the tower taller so it can beam signals for three additional cell phone carriers. But the city has said the company needs approval from the county's Aviation Advisory Board.
In a complaint filed Thursday in circuit court, Inverness attorney Clark Stillwell said the city should grant the permit without requiring the county board's approval. The board advises the county, not the city, he said, and the 1978 resolution that created the board does not address review of cellular towers. According to records on file with the Florida Division of Corporations, Dean is the company's registered agent. His wife, Judy, and son Charles Jr. are also directors.
