MIAMI - Prosecutors have asked a judge to issue an injunction and restraining order to halt the sale of products that were allegedly falsely advertised online as federally approved medicines for cancer, migraines and the flu.
The Food and Drug Administration not only never approved the drugs Cancer Control, Migraine Miracle and Flu Fighter, but the Boca Raton company advertising them never filed new drug applications seeking FDA approval for any of its products, according to the Dec. 22 request signed by U.S. Attorney R. Alexander Acosta.
Flu Fighter Laboratories Inc. maintains Web sites - cancercure.org, migrainecure.org and flufighter.net - that promote drugs claiming to be FDA-approved cures for the flu, migraines and cancer.
The Web sites identify the FDA as the "Fighting Diseases Association Inc."
The prosecutors' motion, filed in U.S. District Court, alleged that the company conspired to defraud the United States and the FDA by advertising and selling "misbranded drugs" and unapproved "new drugs."
Calls after hours Wednesday to the customer service numbers listed on the Web sites went unanswered. A listing for the man identified in court documents as the owner of Flu Fighter Laboratories Inc. and Flu Fighter Corp., Phillip Roth, could not be found.
