Tampa General expansion gets judge's okay

DAVIS ISLANDS - A judge has spoken, apparently ending the battle between Davis Islands residents and the City Council over Tampa General Hospital's expansion plans.

The winner? Tampa General Hospital, a judge ruled earlier this week.

Led by the Davis Islands Civic Association, a group of residents filed a motion in December to overturn the council's rezoning decision to allow the hospital to add 167,000 square feet. The council also approved the hospital's request to acquire a parcel of Marjorie Park for a new parking garage.

Circuit Judge Richard A. Nielsen issued a ruling Wednesday denying the residents' appeal. Nielsen said the association failed to meet the three requirements that would have allowed the court to overturn the council's vote. The plaintiffs did not prove that the city failed to observe procedural due process or observe the law, according to the ruling. The plaintiffs also failed to provide substantial evidence showing that the city's decision should be overturned.

Hospital officials said they were pleased with the outcome and plan to begin drafting design and engineering plans for the expansion project.
