Lawyer plans suit over development deal

By Times Staff Writer

Crystal River attorney Carl Bertoch said Thursday that he plans to file a lawsuit challenging the development agreement that resulted from the settlement between Citrus County and the estate of W.W. Caruth Jr.

He declined to discuss details. The agreement, which was approved by Circuit Judge Patricia Thomas last month, allows the estate to develop a 50-unit housing project on about 70 acres on the Withlacoochee River. Attorneys for the Caruth estate argued that the county reduced the value of the property in question by $730,000 when it eliminated the mixed-use zoning category and designated the property as coastal and lakes, which allows only one home per 20 acres.
