Judge orders dog visitation

A trial date in the custody suit over the Hurricane Katrina dogs will be set on Jan. 12.

ST. PETERSBURG - Noah was at obedience school Tuesday learning how to control his temper.

The St. Bernard that Hillsborough County prosecutor Pam Bondi adopted after Hurricane Katrina has become so possessive that he is aggressive if someone comes too close to Bondi, her attorney told a judge Tuesday.

Nevertheless, Pinellas County Judge Henry Andringa ordered Bondi on Tuesday to make the St. Bernard available so Steven and Doreen Couture of Louisiana can visit with him. Andringa issued the same order to Rhonda Rineker, who adopted the Couture's other dog, a shepherd mix.

Murray Silverstein, the Coutures' attorney, said the St. Bernard's alleged behavioral problems were news to him and his clients.

"That was the biggest, most docile, creature I've ever seen," he said.

Silverstein had asked Andringa to enforce an Aug. 1 ruling for visitation, which he said Bondi and Rineker stopped complying with after several visits in the fall.

Bondi's and Rineker's attorneys argued that they didn't agree to visitation. At a hearing on the issue last week, Andringa called a recess and ordered the attorneys to provide more information.

When the attorneys reassembled on Tuesday, Andringa said, "I intend to order visitation." He then wanted to know if the attorneys could work out the details among themselves.

"I would prefer to defer to you folks," Andringa said. "Do I think you can solve it? Do I need to solve it? Yes."

Bondi, who lives in Tampa, and Rineker, who lives in Dunedin, as well as the Pinellas Humane Society are being sued by the Coutures in an effort to get back the dogs, rescued by the Humane Society after Hurricane Katrina.

The Coutures had been allowed three visits with the dogs between September and October. But Silverstein contended that Bondi and Rineker unilaterally refused visitation without cause or justification, which violated the Aug. 1 order.

With Andringa's decision Tuesday, the Coutures will now be able to see the dogs every two to three weeks starting Jan. 5 until the matter is settled at trial. A trial date will be set Jan. 12.

Both dogs were rescued from St. Bernard Parish, La. Bondi and Rineker adopted them from the Humane Society of Pinellas in October 2005. Bondi adopted the St. Bernard, known as Master Tank, and renamed him Noah. Rineker adopted the shepherd mix and changed her name from Nila to Gracie.

The Coutures tracked the dogs to Pinellas County and sued in June after several failed attempts to get them back.

Bondi has argued that the St. Bernard she adopted was sick and improperly cared for and was not even the dog the Coutures lost. Rineker has contended she adopted an abandoned dog in good faith.

At Tuesday's hearing, attorneys for Bondi and Rineker said they were worried about liability.

Bondi's attorney, Camille Godwin told the judge she was concerned that if Master Tank got aggressive around the Coutures' two grandchildren, that Bondi not be liable for the outcome.

Rineker's attorney, Jeff Brown, who participated via speaker phone, likewise was concerned about liability issues as well as about pictures being taken during visits and later used in court.

Brown also expressed concerns about where the visitation would take place because the Rinekers wanted to be present, but they didn't want the visitation to take place at their home.

Andringa ordered that no pictures be taken and that nothing said during the visitations could be used during the trial. As for the location, Andringa said there were plenty of dog parks in the area.

He also encouraged both sides to move the case along so that both the visitation and larger issues can be resolved.

"We can take it to trial and end this," he said to the lawyers. "I assume that's what you all want, right?"

A sad note is that the increasing agressiveness is a strong indicator that the poor dog is NOT a happy camper. StBernards in particular are a VERY SOCIAL breed. It is DEFINITELY NOT in the dog's best interest to allow MsBondi to continue to keep him.

Give the dogs back. the Coutures have lost enough, the children have lost enough. How dare we judge these people. I work for a Veterinarian...1000's of people don't provide heartworm meds even today. Pam Bondi--grow up!

If Bondi and Rineker care so much about these two dogs, that were together all the time before Katrina, why do they keep them apart now? That is very cold hearted and selfish.

Get you facts straight SUSAN,these dogs were never chained P.S. Do us a favor the next time the people of Louisiana get hit with a cat 4 storm stay out of Louisiana , that way we won't have to sue your citizens who steal our Pets.

Good point Jennifer. It is possible that you could stop looking for the owner. There are still 3,000 people completely missing from katrina to this day. There's a good chance the owners were one of them. Authorities are still finding bodies today

The pets should go back to the rightful owners. These people didnot ask for this to happen. Adoptive family new what they were getting theirselves into. I am still searching for my dog's owner. If they want him back fine. He was hteir's to begin with

Do you think the Coutures fed and watered the dogs that way for 5 years, Laura? Or could post-devastation circumstances possibly had anything to do with whether it was possible to put the water in suitable vessel?

The dogs are now in good homes where they are treated as family member's not as our dogs in the back yard. I remeber that Steven Couture said he left an unopened bag of food and a bottle water for the dogs and said they could bite open when needed.

Even the St. Petersburg Times paper keeps getting the story wrong. Look at the headline to announce this link. It says "these dogs are Katrina refugees"?" That is 100% incorrect. Days later the damns broke and they were sheltered...never refuged.

These dogs were not abandoned. If you were in the Couture's shoe's and had to make decisions at a moment's notice, where would you stand. I hope no one has to go through what the people of St. Bernard had to go through.Give the dogs back.Have a heart

I also stand behind Ms.Bondi & Ms. Rinekar in adopting dogs that were left to survive on their own. I would never leave my pet for any reason. Leave the dogs in their adopted homes. The Coutures should grateful their dogs are in wonderful homes.

Susan is LYING! The dogs were not abandoned, chained in the back yard! If they had been, they would have drowned in the wall of water that flooded the area! Mr. Couture's brother personally delivered them to the shelter area!

The story is not wrong the Cotures did not stay with their dog 5 days they abandoned the dogs chained in the back yard. Once this case is over I can only hope the real truth surfaces so the public can see the real intentions of the Cotures......

Ms. Bondi & Ms. Rinekar I stand behind you 100% and thank you for adopting these dogs and giving them a second chance to experience what life is supposed to be like with a kind and loving family. I know the judge will do the right thing in this case

I can tell you from personal experience that these dogs were rescued they were clearly abandoned by their owners. The dogs deserve the right to a second chance in their new and loving homes. You need to print the real truth behind this story.

What are these people after? For all they have spent time and money they could have purchases several pure-bred pups. I don't trust their intentions in trying to get the dogs back that they had not even taken care of.

Misty, Bondi had the dog 3 mos when this started, the Coutures and grandchildren had them years - WHO should adopt a new pet and move on?? You must not own a dog.

I cannot believe where this case has lead! It is a complete waste of time, taxes, and is an insult to the legal system! For pete's sake, what's done is done. The pets should stay where they are. The Courtures should adopt new pets and just move on!

I personally feel at this point MS. Bondi has proven herself unfit to be a dog parent and an even worse officer of the court. Due to her position she is fully aware of the legalities,I would no want her working in my court. She doesn't play fair.

Why do posters keep saying dogs were "rescued"? They were left with a humane associate for safekeeping until he could find shelter for them! As for Ms. Bondi, why isn't she censured, as law officer she knows better. Disbar her!

Claims that the dogs were willingly abandoned are lies. Mr. C. stayed with them until forced by others to leave. His brother returned as soon as he could to collect & take them to a shelter for safety until they could find house to live in together.
