Distributing fliers, she runs into trouble

LARGO - Just one person was arrested during the tense meeting Tuesday that led to the dismissal of City Manager Steve Stanton, who is planning a sex change operation. But how did a Tampa Bay activist's simple attempt to hand someone a piece of pink paper saying "Don't Discriminate" turn into a felony charge? Police contend Nadine Smith, executive director of the gay and lesbian advocacy group Equality Florida, became disruptive when they told her stop distributing the fliers in violation of a city ordinance. Smith supporters contend the St. Petersburg resident is a nationally recognized social justice leader with two years of nonviolent advocacy. "We believe Nadine is completely innocent," said Amy Mandel, chairwoman of the Equality Florida board of directors, who spoke on Smith's behalf Wednesday. Smith, 41, was released from Pinellas County Jail early Wednesday after posting $5,250 bail on a felony charge of resisting arrest with violence and a misdemeanor of disturbing others' assembly. Tuesday night's special meeting drew nearly 500 people, many of whom came to make impassioned pleas either for keeping or firing Stanton, who said last week he is planning to have a sex-change operation. The city assigned extra police and firefighters to the meeting. Officers had been instructed to stop the dissemination of fliers for three reasons, said Largo police spokesman Mac McMullen. Fliers present a fire hazard; plus, when they end up on the floor, people can slip on them, McMullen said. Given the already emotionally charged meeting, city officials also thought that fliers could become further disruptive, McMullen said. Smith also lacked permission to pass out the fliers, as required by city law, he said. "The gist of it was for the safety of the people that were engaged in this process and also to ensure there were no disruptions," McMullen said. According to witnesses and police, Sgt. Butch Ward approached Smith in the lobby and tried to prevent her from handing a flier to Charlie Deppish of Tampa. Deppish said he asked Smith for the piece of paper. But McMullen said officers had already seen Smith passing out fliers inside the building. Deppish said Smith wanted to know why she could not give him the piece of paper. "He said, 'I'm not going to argue with you,' " Deppish said. "She said, 'I'm not arguing. I'm just asking, why?' " Ward tried to escort Smith outside where she would have been allowed to pass out the fliers, McMullen said. But he said that on the way out Smith became disruptive, telling people that she was being arrested. She was taken to an area designated for potential arrests, McMullen said. He said there was "pushing and shoving" and it required four officers to arrest her because she was not complying. "If she was upset and struggling ... I wouldn't blame her," said Deppish, an actor who said he came to the meeting to support Stanton. "She was being manhandled."

I am a gay man who lived in the Tampa Bay Area for 10 years. I've met Nadine before and she is a intelligent and kind person. This seems like what happens when an area (Tampa Bay) allows homophobia and racism to bloom. It wasn't that way 10 years ago

Nadine was peacefully exercising her First Amendment rights, and for doing so the Largo police have turned her action into a felony.
Their actions were a shameful display of police brutality.
Urge the Largo police to drop the charges.

This is the kind of thing that is making our city look bad to a whole segment of the population, and loose inicome from visitors who bring in tax dollars. I have seen Nadine Smith in action, & met with her personally. She is a gentle person.

Nadine spoke at the second Florida Collegiate Pride Convention at Florida State University 2005. I was very impressed with her. I would note that the city has an ordinance that should have been adhered to.

Passing out fliers protected by the first amendment. Police need a much better reason than "fire hazard" or "slip danger" to prevent the passing out of fliers. If those were real concerns they should have sent janitors rather than policemen.

Richard, You don't read much? Nadine doesn't need to be arrested to get her name in the paper. Size wise a dwarf could have put her on the floor but it took 4 violent cops. How macho of them.

John, Unless you were there you don't know how she reacted. I'd guess you don't know her either. Tell us why the Baptist churches were allowed to pass out hundreds of fliers without fear of fire or slip and falls.

I know Nadine Smith. She is incapable of violence or anything close. She's calm, gentle and has 10 years of experience being calm under these circumstances. It's ridiculous. They wanted to make an example out of someone.

Of course the police are going to claim she "became disruptive" and "resisted arrest". What are they gonna say? "Yeah, we arrested her because she was handing out a flyer?"
Another incident in the heap making FL look like a bad joke to the world.

The people who left comments about Nadine looking for publicity do not know the woman obviously. Nadine is one of the most loving non-violent women I have ever known. Shame on the police!

I've known Nadine Smith for 14 years. She keeps her cool in the most difficult circumstances, always showing poise and consideration for others. I can't believe that she did anything to provoke the kind of treatment she was given in this instance.

This is out right discrimination, since the police allowed Religious groups to distribute pamphlets before and after the meeting. At approximately 5:00 PM, I approached Officer Sahoski, who shrugged his shoulders and stated he knew: A police agenda!

A fire hazard? My office would be a ball of flames if papers/flyers were that dangerous. Still she should have complied with the Police and the called the ACLU, so they could make a big deal of nothing. She was looking for trouble and got it.
