Developer sues county to build apartments

Seven Hills Inc. sued the county Tuesday, saying the County Commission improperly denied its request to build a 120-unit apartment complex last month. The land for the complex had been designated for use as an assisted living facility as part of the 20-year-old Seven Hills development of regional impact. The county should have allowed the complex because it did not meet the legal definition of a "substantial deviation" from the original plan, the suit states. The complaint also says commissioners did not adequately disclose their conversations with residents about the proposal, as they are required to do before casting votes on zoning issues.
