Stanton backer won't be charged

LARGO - During the tense meeting in February, the issue before city commissioners was whether to fire transgender City Manager Steve Stanton. Stanton has long been fired. But until recently the fate of civil rights advocate Nadine Smith, arrested at the February meeting, still hung in the balance. Smith, who supported Stanton, was jailed, accused of resisting arrest with violence, a felony. Now her fate also has been resolved: Prosecutors in the Pinellas-Pasco State Attorney's Office have declined to file charges on the felony and a misdemeanor of disturbing other assemblies. "The state attorney, having taken testimony under oath at a state attorney investigation, concludes that the facts and circumstances revealed do not warrant prosecution at this time, " prosecutors said in a new court pleading. The assistant state attorney who investigated the case was not available Tuesday to elaborate. Smith, 41, of St. Petersburg is the executive director of Equality Florida. "It has been extremely frustrating to see the complete fiction coming out of the Police Department and not (be) able to say so, " Smith said Tuesday. "Everyone ... really expected the charges to be dropped." Largo police officials, however, stand by Sgt. Butch Ward. He said he tried to prevent Smith from passing out fliers inside City Hall because city officials had prohibited it for the already emotional meeting. Officials "believe Sgt. Ward's actions were appropriate based on the rules set forth by city administrators in terms of participant behavior during the hearing, " said Mac McMullen, a spokesman for the Largo Police Department. Police have said Smith was asked several times not to pass out fliers that read "Don't discriminate." Instead of complying, she asked "Why?" As she was being led out and told she could hand the fliers out outside, police reports state, she "began yelling, 'They are forcing me to leave, ' and 'I'm being arrested.' " Once an officer started to take her into custody, the reports state that Smith "pulled her arms away" and struggled to keep from being handcuffed. It took four officers to put the cuffs on. Smith maintains that Charlie Deppish of Tampa asked her for a flier and she gave it to him. She said when the officer took the flier out of Deppish's hand she asked why it was illegal? The officer said, "I'm not going to argue with you" and grabbed her, according to Smith. In a normal tone of voice, Smith said, she alerted people she knew that she was being arrested. Smith said she believes her arrest was meant to intimidate people from exercising their First Amendment rights. McMullen pointed out that Smith was allowed to speak at the February meeting and at a the subsequent meeting when Stanton was fired.

Not all police. Just knuckleheads who violently arrest people for handing flyers. Largo cops gave themselves a bad rap.

WHY ARE YOU SO QUICK TO CRITISIZE POLICED OFFICERS? I think this incident deserves no attention whatsoever. No wonder our crime rate is soaring - the law gets a bad rap and no one wants to help them out. Shame on all of you.

Largo is going to be paying out some very large settlements after all the lawsuits that will be filed. The taxpayers of largo will end up paying in the end for this mismanagement.

Nadine Smith is my hero. She has every right to sue Largo, and I hope she does. I'm grateful the charges were dropped, but they should never have been brought in the first place. Sgt. Ward overreacted. End of story.

This is why citizens have every right to fear the police, who are public servants employed to protect and serve. Such authoritarian behavior is threatening to the very core of our democracy. Congrats to the State Attorneys Office for the right call.

Ms Smith is hardly a threat to anyone physically. Those who fear her know she is right in her actions and words and don't want her to be heard. More should be like her; stand up for what they beleive in regardless of press. Way to go Nadine Smith !

She should have been charged. She is a blight on this community and society. But at the same time why waste money on the court process since the point was to get her to stop handing our fliers and that was successful.

Nadine Smith should be considered a hero for standing up against the bigoted practices of the Largo commissioners and the police who are just as guilty of bigotry and incompetence in public service for upholding them. Way to go Nadine!

I've known people who simply asked why they were being arrested who were charged with resisting w/o violence(seriously) so no surprise they tried to pin this. Focus on the real crimes- ALL police depts. should. Not just those covered by media.

I come from a law enforcement family-my father, two uncles and my husband. Largo should be ashamed of how they treated this woman. Remember there are good police and deputies out there protecting us. Not everyone has a God complex and a short fuse

I've known Nadine for quite a while and the idea that she would "resist arrest w/ violence" was ludicrous. Four officers to restrain her? Asinine. Charges should never have been lodged. This was suppression of constitutional rights. Period.

This entire debacle is an embarrassment for the Tampa Bay area. Stantan should not have been fired, and this woman should not have been arrested. The extent to which people will go to spread hate is appalling. What happenned to love thy neighbor?

Sorry, am I reading this correctly? The woman was handing out fliers and gets charged with a felony? Jesus H. Christ, what isn't a felony these days? We need to get rid of about half the 'felonys' on the books and just let people live.

Both the cops and Smith were itching for a fight that night. The State Attorney's Office got it right for a change. Doesn't change the fact that discrimination in Florida is alive and well. If the people of Largo want change they should vote for it!

It's nice to see that the 6th Circuit State Attorney's Office recognizes a violation of First Amendment rights, and refused to charge Ms. Smith with "disturbing a public meeting." She was not even in the meeting chamber... Ridiculous overreaction!
