With a gun in his face, he still said no
Robbers shoot a man in the face with a BB gun. Two teens are arrested.

John Stofer III, 71, who was shot in the face by a juvenile with a BB gun on Wednesday night, learns from a call on his cell phone that Tampa Police have the suspected children in custody. "I don't want him in a juvenile home," he said. "I don't know his background, but give him something productive to do. It's cheaper than making a criminal out of him... I would accept his apology."

TAMPA - John Stofer III's mother always told him: Cherokees do not beg for mercy, even in the face of death. Stofer, 71, followed his mother's advice Wednesday night when armed teenagers approached his plumber's van as it sat in a Burger King drive-through at 901 E Fowler Ave. Give us your van, the two demanded. Then: Buy us food, or we'll shoot you. "I said, 'Well, shoot' and he did," Stofer said. He pointed through the back window of the van, at his plumber's tools stacked on the floor. "If you take this, I can't earn a living." Luckily for Stofer, the two attackers were packing only a BB gun. The bullet left a small red dot on the left side of his nose, near his eye. Stofer declined medical treatment. What would medics do - give him a bandage? He was raised in Tampa by his mother, Loretta Fanny Hummingbird, who grew up on a reservation, he said. Stofer, whose father was German, said his mother taught him pride in their heritage. "A Cherokee is raised not to doggone beg for mercy!" he said. He sounded almost offended that the attackers expected him to concede to their demands. Tampa police arrested two 14-year-olds Thursday who were in the area shooting pellet guns. Both were charged with armed robbery in connection with the incident at the Burger King. One also was charged with aggravated battery. They were taken to the Juvenile Assessment Center. Shooting someone with a gun - it's too late for a slap - lock the thugs up - let them be "bubba's" friend.

James - I knew someone who worked there. The kids had fun playing video games and watching DVDs like the Fast and the Furious.

These kids used a device which expels a projectile (aka a gun) in the commission of a crime. They should be subject to the Florida Gun Crime law, tried as adults, and sent to the state lockup. Swatting their behinds as juveniles solves nothing.

We all know what the probable future holds for these kids...killing someone then Fl State Prison...would've been good if the parent(s) could be snt to prison in parallel with the kids in juvee...huh?

I didn't read anywhere in the article that it gave the race of the teenage criminals, Steve, so why if Mr. Stofer had defended himself, would he have been accused of a racially motivated hate crime???

My Child spent 4 years working with Pinellas County JDC and Staff. She turned her life around and is off of crime and rugs. Thank You Pinellas County Juvenile center Your the greatest.they should send these boys to Pinellas County its not like tampa

Jim: that is an excellent idea. I couldn't agree more. Get an officer to watch their every move and send them to work with Mr. Stofer. Apparently they have too much time on their hands. They need to learn to work and not suck off society!

Right, slap them on the wrist now and let them grow up thinking no one will ever put them in jail. Can't wait to read the paper in 4 years when one of them goes to jail for shooting killing someone. I do agree w/ John about juvie hall..no good.

Too bad he didn't hit them with a plumbers wrench and killed them both - although he probably would have been accused of a hate crime - or racially motivated, etc.

They should make them work with him pulling water heaters and digging out clogged toilets for a while. Could learn a few things from him as well as a little respect on how hard it is to make a living!

They are juveniles, the worst that will happen to them is they get to hang out and play video games in juvie hall.

I hope these kids don't off easy. All too often, kids get off easy because they are only "kids" and they learn there is no real consequence for their actions. Even with BB guns, they could have hit an eye and blinded him.

Good for him. It's a shame he wasn't armed, if for nothing else than to give these punks a feel for what a real gun looks like when it's pointed in your face.
