Wal-Mart fights decision
After having its bid for a Supercenter on Barclay Avenue denied, the retailer seeks a special review.

BROOKSVILLE - Soon after the county denied Wal-Mart's request to build a Supercenter on Barclay Avenue, County Commissioner David Russell said he expected the company to challenge the decision.
Not only was Russell right, but the company singled out his comments in a letter informing the county it wants to use a special magistrate to resolve the matter. If this is unsuccessful, the company retains the right to sue the county, said David Theriaque, of Tallahassee, Wal-Mart's lawyer.
His letter to the county quotes Russell as saying at the May 9 meeting that commissioners are "here to analyze things not only objectively but also subjectively ... . That's our right."
This showed Russell was biased when he cast his vote to deny the right to build the store, Theriaque argued in the letter. He also noted that Russell and Commissioner Chris Kingsley had shown their bias by saying publicly, in the Hernando Times and other publications, that they planned to vote against the company's request before the meeting.
Partly because of this, the commission's decision to deny the store was "unreasonable, capricious and contrary to the established Florida law," Theriaque wrote.
He argued, as the company has said previously, that Wal-Mart has a legal right to build the 185,000-square-foot store on the property because it is zoned for commercial use. Also, because the land was part of a larger development approved in 1982 -- before the county created a comprehensive plan -- he said the property is exempt from comp plan requirements.
County planners and the Planning and Zoning Commission agreed with the retailer and recommended the County Commission approve the plans.
The commissioners instead sided with the many homeowners who attended the meeting and argued that the site was too close to residential areas and schools, and that it would cause severe traffic congestion on Barclay.
But Russell, in May, also said the company might be reluctant to harm its public image by suing the county. He was also right about that. The company has asked for the case to go to a magistrate who will recommend a resolution rather than order it.
"The special magistrate will explore whether we can come up with approach to resolve the matter," Theriaque said. "Our hope is to not go to court."
The magistrate also will write a report analyzing the arguments from both sides and stating which one is stronger. The County Commission will vote whether or not to approve this report.
If the matter does result in a suit, this report will be part of the evidence, Theriaque said. "It does carry some legal weight," he said.
But Russell said he would not vote for any solution that allows a Supercenter on Barclay.
"My position hasn't softened one bit," he said on Friday. "If Wal-Mart wants to be a good community partner they need to listen to the community leaders ... . I don't believe that location is suitable for a Wal-Mart Supercenter or any super store."

You all complain about the 3 walmarts here but there is 6 Publix's in the Hernando area and they are close to each other. So I guess it is a Walmart issue. Walmart is way cheaper than Publix and have more of a variety. So Please build another walmart

If you look at what walmart usually does in these situations, they settle on some concessions from the county and find another location. Once in a while they go to court and win 5 yrs later, but they won't do that wtih so many better sites here.

Jag I guess you don't get it either, the commissioners did wrong because Walmart did everything they were suppose to do and beyond. So I am sure Walmart will get to build now anyway and they won't have to put in the cross lights for the kids but will

This area may have been zoned commercial in the '80s, but this is clearly in the middle of a residential area that would have no hope of handling that kind of traffic. Kudos to the commissioners for realizing that.

Walmart would not be in residential area. It is going into an area that is zoned for commercial so the people that moved into that area should have known that was commercial property. There is a correctional facilty not far from Nature Coast school.

Everybody here is missing the point. This vote was about putting a huge supercenter in a residential neighborhood and near schools. Wal Mart has every right to build in a safe location that can handle the traffic. Barclay is not that location.

I am so tired of people bashing Walmart. They do good for communities. I know for a fact that walmart contributes to our schools and also at christmas gives gifts to kids they don't get things. The paper should publish the good stuff about them too.

It is too funny that the people that bash walmart are probably their number 1 customers. Walmart gives money to the community and to the needy. If anyone is being greedy it is the snobs of the gated communities and the rich commissioners. Build......

Like why do we need another walmart we have 3 already.Walmart needs to relize that we do not need them.Go build somewhere else.It only a 15 min drive to walmart on 50 from pristine Keep Saying NO Russel. Plus its to close to the middle school Say No!

Russell doesn't posess the faculty's necessary to hold his position any longer. Walmart helps keep familys cost of living expenses reasonable. That is why they are succesfull. Russell would rather have you pay $20 for shampoo and toothpaste.

its funny walmart wants to build umteen stores in some places but there is a town in this area that has nothing and a lot of people with money.no stores no nothing. people have to drive a long way to go to a store of any kind. i even emailed them.

So where do the County Commisioners shop? Probably Wal-mart. Just let them bild it instad wasting more taxpayer money on the lawsuit..which Wal-mart can sustain for YEARS with all of thier money. This county needs more jobs.
