Teacher 'in love' sentenced to 5 1/2 years

Dozens of parents and colleagues defend the teacher who had sex with the 17-year-old.

CLEARWATER - Five dozen teachers, parents and students filled a courtroom Friday.

They came to ask for leniency for Daniel Zdrodowski, a former music instructor at Seminole High School, who was about to be sentenced for having sex with a girl in the band.

He was 28. She was 17. Now 18 and romantically involved with him, she refused to testify against him.

"I believe those two people fell in love," testified Joyce Ostrom, a 61-year-old elementary school teacher who has known Zdrodowski since he was young. "This is a case where every law doesn't fit every crime."

Pinellas-Pasco Circuit Court Judge Nancy Moate Ley was not swayed. She sentenced Zdrodowski to 5 1/2 years in prison. He could have received 15.

"There's is no rule that says you are excused from having sex with a student as long as you are a nice person," said Ley, noting that she often gives talks at schools. "Mr. Zdrodowski, you have betrayed the trust that was placed on you as a teacher."

As deputies led Zdrodowski away with his head down, the young woman with long blond hair, black slacks and a blouse stared ahead.

In May, prosecutors unsuccessfully asked Ley to jail her for refusing to testify. The Times is not identifying the woman due to the nature of the crime.

On Friday, she outlined the relationship on the stand, trying to help attorney Debora Moss secure probation for her boyfriend.

In early 2006, Zdrodowski assisted the band director at Seminole High. He was also the music director at Seminole Middle School.

She said they started dating. Eventually they had sex at two places, including his house.

She said they decided to end their romantic relationship in March 2006, until she turned 18 later that year in December.

"Have you expressed your desire to not prosecute this case?" Moss asked the young woman on the stand.

"Yes," she said.

Parents and former colleagues who testified described a clean-cut young man who was loved in the school community.

When he was hired, they said he continued the music excellence for which Seminole Middle is known.

He just made a big mistake, they said.

"Our band family was devastated," testified Lindsey Diana, a parent who volunteers at Seminole Middle. "He was a model citizen before this incident. And he will be again."

The young woman's mother testified that she was not happy about the relationship when she found out about it. "This was bad timing," the mother said. "But I can see that they belong together."

Zdrodowski has paid a heavy price already, some testified.

"He's lost his ability to teach in the school system," said John Creveling, 58, who added that his son thinks of Zdrodowski as a role model.

"The passion of his life since ninth grade is gone," said Zdrodowski's father, John. "Now he faces the prospect of wearing the scarlet letter."

When he took the stand, Zdrodowski said that he took responsibility for his bad judgement.

"In this case, I fell deeply in love," he said. "I'm asking for mercy and leniency."

They are both adults now, Moss told Ley. Except for eight months, the relationship would have been legal.

"Is (jail) fair?" asked Moss. Is it right in this case?"

Assistant State Attorney Holly Grissinger asked Ley to look at the totality of the situation: He was a teacher. She was a minor student. Teacher and student had sex in his house.

"It is the law," Grissinger said.

Said Ley: "This is a sad day for everyone involved here."

Was it a stupid thing to do? Of course. Should this man be in prison? No. House arrest and community service would be reasonable. This was a 17 year old, not a 14 year old girl.

Double standard or no double standard, teachers are not suppose to sleep with students. In fact, if he or she is under 18 and you are 18 and up, its wrong. He was a professional and screwed up but people are rallying for him!! You people are nuts!

Elvis Pressley was 24 when he dated Priscilla and she was just 14. Loretta Lynn's husband was 23 when he started dating her and she was 12. Yet we love these people, but ready to crucify others. The age of consent is 16, stop having exceptions!!

She was 17 and old enough to know what she was doing. She went to HIS house and knocked on his door. Hello! Three months later-no jail time. Sad this judge sees fit to ruin the man.

I agree that the LaFave case was a disgusting miscarriage of justice, and one that happened solely because she was a cute woman. HOWEVER this man should face his time. He was a teacher. End of story. Love can wait until she is not a student.

When I was 14 I had a love affair with my 27 yr old math teacher...it just didn't get beyond kissing. Regardless, it was wrong for him to pursue me. I wasn't emotionally realdy for someone his age. My daughter is now 15. Yikes!

I'm 17. I dated a 28 year old. The difference is we weren't stupid enough to let the relationship get inapropriate. I don't think he deserves 5 years, but he should be smacked in the head for being an idiot.

Coninued...Also --- there is a law that limits the age of consent depending on the age of the other person. In the Dukes case, he was not over the age of 24 when he had relations with the 17 year old. Before you criticize, know the law.

I am not condoning teachers having sex with students however, you must remember before you cry judicial inconsistency that Lafave did not have the same judge. So do not chastise the judge in this case as she had nothing to do with Lafave's case.

This is obviously a case of a double standard. Debra LaFave gets probation and this guy gets 5.5 years in jail. Having sex with a student is wrong and I know it's the law but why isn't it enforced when it's a female teacher doing the crime.

Its funny how the women teachers get probation for the same offense and this guy gets 5 1/2 years prison. Why make an example of him? Why weren't the pretty women teachers convicted of the same crimes made examples of? Does money,looks or gender help

Justice was not served. Had this been a 28 year old teacher and a 17 year old boy the results would have been much different. Shame on the judge and prosecutor!!!

Elijah Dukes said he had sex with a 17 year-old girl in her foster home, but authorities said no crime, it was consentual. So its only a crime if you are a teacher instead of a pampered jock. Something wrong here big time. Judge commute the sentence.

It scary to see that a few of the band parents quoted above think it's ok for the band instructor to have sex with aband student as long as they are "in love." WOW...just wow.

We send our children to school for an education not to be praid upon by the teachers. What he couldn't find a mature young adult in his age group. Come on lets be real how come the parents didn't know what was going on with their own daughter?

I too agree that probabtion would be enough. He made very poor and immature choices and will paying for them. When will people grow up. we don't always get what we want, in the time we want. They could have, and should have, waited. He knew the law.

How much jail time have Debra Lafavre and the innumerable female teachers who've had sex with their 12-14 year old students had to endure? Asst. State Attorney Grissinger says it's the law but apparently, it's applied selectively.

The bible tells us to keep our memebers under subjection. I believe that this teacher should have done that. Love doesn't always mean sex.Just like he stopped and suggested that they wait until her 18th b-day afterwards,he could have done that before

He should have been a cute white girl.They don't go to prison in Florida.Debra Lafave has a minimal sentence and a much more serious criminal offense.He did betray the trust but 5 1/2 years in state prison?Punishment should fit the crime.

A male teacher has sex with 17 year old and gets 5 years,a married female teacher has sex witn a 14 old student and gets probation. Is that Justice?
