Religious suit wins $300,000 award
A pharmacist who resigned after 14 years with the VA says she was denied time off without pay for Jewish holidays.

TAMPA - A former pharmacist at the Bay Pines VA Medical Center has won a $300,000 federal jury award against the Department of Veterans Affairs over an allegation of religious discrimination. Lynne C. Krop, 45, of Clear-water said during a four-day trial that ended Thursday in U.S. District Court that the VA refused to allow her time off without pay for Jewish religious holidays. Krop's attorneys argued that the VA was obligated under federal law to provide the time off. Instead, the VA told Krop to take vacation and sick leave, the suit said, which she wanted to save for family vacation. Krop said she was essentially forced to resign over the dispute in 2004 after 14 years at the VA. "This was clearly unreasonable," Krop's attorney, Joe Magri, said in an interview on Monday. "They were dealing with an employee who was deeply into her faith and family. Somebody who clearly did such a great job for veterans is no longer working for the VA over foolish reasons." Magri said Krop was an outstanding and highly respected employee. Krop, who worked as an infectious disease clinical pharmacist and clinical residency director, could not be reached for comment. The VA declined to comment pending an appeal. Krop said in the lawsuit that it was VA policy to allow employees to take time off without pay for any reason. In fact, she had previously been allowed time off for religious holidays. But she said that changed when her supervisor retired. In December 2003, Krop said the new supervisor told her that she was taking too much time off, noting that Krop had used 146 hours of leave without pay in that year alone. The new supervisor also refused to allow her to come in to work 15 minutes later several times a week so Krop could bring her children to school. On those days, Krop would have worked 15 minutes later. Her supervisor said Krop wanted to take time off for vacations and family events, as well as religious holidays. Her supervisor said that if he made an exception for Krop, he'd have to do it for everybody. The VA said it offered Krop alternatives, other than using vacation leave, that would have allowed her to take off the holidays. After the dispute, Krop said her supervisors put her under a microscope, looking for reasons to reprimand her. "It became intolerable," her lawsuit said, "and she felt that the only way to salvage a positive professional reputation was to resign." The VA denied the charge. William R. I work for the VA and we are so short staffed that when anyone takes time off it makes it very difficult for the workers left behind, and if one person constastantly takes time off then the others don't get to take off. all employee's treated fairly.

The following facts were proven at trial:
Krop used a max. of 85 hours, not 146.
Her job was autonomous; she made up all missed work herself.
Krop's boss received so many complaints from his staff he was ultimately transfered to Arkansas.

146 hours = more than 3.5 weeks. This is just shy of a full month.
A full-time job is considered 40 hours per week, 52 weeks a year, with allotted vacation/sick time. Not "Take time off as I feel like it" time.

Hey Rob, your point is abit rounded off though not totally missing. Everyone gets the observed Christian holidays off not just the Christians. This woman just wants special treatment and is using her religion as an excuse. The courts bought it we pay

Wow Chris. Pretty intelligent comparison: A religion older than Christianity and "Festivus." I think you'd be upset if your employer wouldn't let you off for Christmas or Easter. "Oh but that's different," you say. Really? How?

The question no one has asked is did she also want the other holidays off. If she took her religious days off work the other religious holidays and no problem. but not both.

What a joke. Who gets nearly a month off for personal holidays, plus vacation and sick time, plus the normal holidays? She should have been fired for missing so much work! Where do they find these juries????

Missing the point on the days/hours issue - still over three weeks @8hrs a day. Also the calandar dictates whose off, do you think ALL employees got off on Xmas & Easter - the only holidays that are Christian? If I practice both faiths doI get both?

Now that I have paid holidays, one of the most sacred days to me is not included. I take Good Friday off annually as a paid personal or vacation day. I'm happy that I no longer have to choose between working on that day or having a short paycheck.

I'm a Christian, and there have been many times I've worked during the Christian (and secular) holidays for no additional pay, or have taken them off unpaid. Many (usually low-paid) workers do not have any paid holidays.

146 Hours is 18.25 days that someone else had to do her work and theirs. I fully support accommodations for religious and family concerns, but 18 days and then vacation - a business still has to operate, it cannot on her terms.

I am Christian and we receive Christian holidays off with pay, and she was asking for her holidays off without pay. I see no harm in that.

and if i'm late i have no problem making up my time-get real lady and face your responsibilities as a working adult - oh and only two days off for my christian holidays. they lord loves us in or out of church

Let's see, she took 146hrs = 18 1/4 days off (8hr work day) unpaid for "religious" reasons. Also expects to have her time off for regular vacations & wants to come in 15 minutes late for family reasons. She seems to feel "entitled" to everything.BS

This kind of crap has been happening for a gazillion years, people think, that if they give you a job, they should be allowed to treat you like a second class citizen. everyone is entitled to paid time off for their religion.

Raunchy Rob, it is you who is missing the point. This is America and we celebrate American holidays. In otherwords, go to another country and see how many American holidays they celebrate. We cannot just make up when we want to take off.

I don't know of any job that would allow 146 hours of unpaid leave in a year. That's nearly a month! On top of that she probably had at least another month of sick/vacation paid leave. She wanted a part time job w/ full time benefits.

Good for the Muslims - no one ever said religion must be confined to Sundays. If they want to take unpaid time to observe their religious beliefs, more power to them. I for one am glad the VA had to pay up for their discrimination and bias.

You are missing the point like most do. We generally get christin holidays off and nothing else, so how is that fair. America is a melting pot and that's what makes us different than.... Iran or some other counrty ruled by religion

Another example of brain dead jury verdicts. With 146 unpaid days (I don't think there are that many Jewish Holidays) and vacation/sick days, she took off close to 2 months in one year alone. Someone else had to do her work when she was not there.

Ahh, where to begin. I wish I could come in 15 minutes late every day, take of holidays for my religion Festivus and be a slacker. Wait, that's not allowed? OK, I'll quit.
