Police report that the man was rude. He says the police overreacted.

ST. PETERSBURG - Tyrone Square Mall officials on Sunday said they stand behind their security guards' decision to seek a trespass warning against a man who claimed he couldn't find his car in the parking lot. Security guards at the mall asked St. Petersburg police to issue a trespass warning to Larry DiSalvo after guards reported seeing him peering into cars and wiggling door handles in the parking lot. DiSalvo, 57, of Treasure Island, says he had forgotten where he parked and was searching for his car. He claimed security guards and police overreacted when they not only issued him a trespass warning, but snapped his photograph and told him to stay off the property for good. A story about the incident was published in Sunday's St. Petersburg Times. In a statement released Sunday evening, mall marketing director Tara Houser said: "Mall management has reviewed the situation with the St. Petersburg (Police Department) and we agree that the situation and final investigation did warrant the trespass." St. Petersburg police on Sunday also released a report, which paints DiSalvo as anything but a perfect gentleman during the incident. The report states that DiSalvo made "rude and racist remarks" toward the security guards. Police wrote that DiSalvo referred to security guards as "Nazis" and said that one guard "must be from New York as he looked like he was Italian and was on welfare." In a phone interview with the Times on Sunday, DiSalvo denied making those remarks. "That's a lie. I'm Italian," DiSalvo said. "They're going to lie through their teeth because, I believe, they should not have done what they did, especially after I was totally cooperative and I gave them positive identification." The police report also states that DiSalvo was rude to the police officers, threatened to call the media and "to file a lawsuit against everyone." The report states DiSalvo told officers he knew the owner of the mall and told one security guard that he would "have his job." DiSalvo said he was trying to find his car in the mall's packed parking lot Saturday morning when he was approached by mall security. A security guard told DiSalvo that he had been seen peering into cars and trying to enter them, DiSalvo said. He said he was asked to leave, and did so, walking across Tyrone Boulevard to Kinko's. In their reports, police wrote that security guards told them DiSalvo ran from them to the Kinko's. DiSalvo said he intended to call for a ride and to have someone pick up his car for him. Instead, police came to Kinko's, searched him and took him back to the mall parking lot to retrieve his vehicle, which security guards had located in the interim. DiSalvo, a retired real estate agent with no apparent criminal record, said Sunday he never will visit the mall again after 14 years of shopping there. "Even with an apology from them, I wouldn't go back to that mall with that type of organization in place," he said. "I do not feel safe."

Dorothy please you wish you has 100 friends. Second old man you got caught doing something wrong and you got to pay for it. You ran your mouth thinking that because you are a senior you can get away with it. The cops had no reason to lie about you

Scary--I rented a car and parked at a mall--walked at least a mile back and forth and checked the key in two cars I thoght were it. YIKES! Years ago whe we saw a car that left lights on it was pretty normal to open it and turn em off.

How very typical of modern society. A person is guilty until proven innocent...and if the cops want to make up a story, they get believed but the oppressed citizen doens't stand a chance. We call that JUSTICE these days!

while i haven't contacted my friends yet i have told my family i will not be going to a simon mall until they apologize.. his car was really there duh,duh. they should've offered to help. i live prac accross the street and i will drive elsewhere,,

Why does a man only 57 years old have such a hard time identifying his own car??? I'm older than he is & I wouldn't be peeking inside & jiggling door handles of other peoples cars unless I was trying to break into them.

I agree with Dorothy. I still will not shop at Tyrone Square again. I had originally said until they issued a public apology. But after what they're accusing him of now, I don't think an apology would change my mind.

I haven't changed my mind either since yesterday. Boycotting Tyrone and all other Simon Malls. The guy is Italian, why would he say anything bad about Italians if he is one himself?

This mall has an unfortunate reputation for auto burglary, and so security needs to be proactive. I support the mall staff in this case. I doubt the police and the guards are all conspiring against this guy. Sounds like he's an obnoxious jerk to me.

I think they should have helped in locate his car in the beginning, they relied on heresay and shouldn't have. Just because he might have been rude could all be blamed on the attitude he recieved from the security officers. Shame on them for rudeness

I believe the guy lost his car. As far as being italian from ny on welfare as long as he is wearing a tomato sauce stained wife beater and has a cheap can of beer in his hand don't assume I KNOW I'M 1 !

This guy is either a thief or a nut. If he is looking for his car, why is he trying door handles and looking into car windows? His car is not parked inside the interior of someone else's car.

sounds like the times got the whole story on this printing. too little too late. people shop in malls everyday and this doesnt happen, what makes disalvo so believable? i wouldnt want someone using disparaging remarks at me. good job tyrone square

I believe DiSalvo. I think these security guards get high on power and do not have the proper training. Who cares if he was "rude". A real cop could diffuse any situation while rent a cops seem to like to add fuel to the fire. I hope DiSalvo sues

This is nothing new for rent-a-cop wannabes. I have a friend who went through the same thing at one of the theme parks. He was "rude" also, produced a receipt for the park, and was violently beaten and tasered then arrested. They dropped all charges.

I would like to see the security tapes which will either prove or disprove this whole accusation. But I tend to believe Mr. DiSalvo. The security cameras at these malls are everywhere. He needs a lawyer to demand those tapes.

I find it amazing that the security guards were able to locate the car after the "altercation"!As far as being "rude and making racist remaks", if anything like that happened to me, I would react the same way. I will never again visit TSM!!!

Malls are for folks who like to people watch. They inflate their prices and call it a sale. I've not shopped in a mall in 14 years and not ever felt harmed from it. I bet the guards are making it all up to look good. Isn't there cameras out there?

I have NOT changed my mind since reading yesterday's story. DiSalvo should receive an apology. I have googled the location of all Simon Malls & contacted by email at least 100 friends & family not to shop at those malls until there is a retraction.
