Family moves to sue over jail death

On the day after Dorothy Dian Palinchik died, her family hired an attorney and took the first step toward filing a civil rights lawsuit against the Pinellas County Jail. Palinchik, a 42-year-old St. Petersburg woman, was booked into the jail Feb. 13, charged with stealing a cheesesteak from Publix. Over the course of her 10 days in jail, she fell ill with what family said was a staph infection and severe pneumonia. She died Thursday at Largo Medical Center after six days in a medically induced coma. Palinchik's family thinks she acquired the infection while in custody and blame the jail for not treating her or taking her to the hospital sooner. "Someone went into the jail apparently very healthy and became sick enough that she died," said Mark Buell, the family's attorney. "The question is not where the germ came from, but did they give her appropriate medical care or were they indifferent?" Buell said the civil rights action in federal court would have to show the jail acted with "deliberate indifference" to Palinchik's medical care. Sheriff's Office spokeswoman Marianne Pasha said she could not release details of Palinchik's medical treatment. She did say Palinchik showed no signs of methicillin-resistant Staphylococcus aureus infection when she was booked. An autopsy was performed Friday morning. About the same time, the family made arrangements to have Palinchik's body cremated. Boyfriend Michael Mullican said he planned a memorial ceremony next week. Annette Olds, Palinchik's older sister, said her sister's rapid descent was shocking. When Olds went to the hospital Feb. 23, her sister was in a medically induced coma, but no one knew she had MRSA. It wasn't until later they discovered she had the highly contagious staph infection. "She suffered so much," Olds said. "They had an obligation to take care of her while she was sick." So the family is shocked over her death... isn't anyone in her family shocked that she was stealing food? Go ahead and sue, that will bring her back. Amazing when you drag a hundred dollar bill through a trailer park what you will find.

Man... talk about hiring the attorney before the body gets cold. if they get one nickel from the taxpayers then you can chalk up another one for the ad guys. I liked society better when crime DIDN'T pay. If you can't do the time, pay for your food.

I AM VERY SORRY FOR THE LOSS OF YOUR DAUGHTER. SUE THEM TO THE FULLEST. THE COP'S IN FLORIDA ARE SOMETHING ELSE. AND KNOW THAT THIS HAS COME OUT YOU WILL NOT BE THE ONLY ONE WITH A LAWSUIT. MY GOD HELP YOU WITH THE LOSS OF YOUR DAUGHTER.

More people looking for a free hand out.They should do more research on MRSA before running to a lawyer.We thought my son had it and we did the research.It affects everyone different.What's the rush to cremate?Burn the evidence of some other problem?

The health care in our penal institutions is virtually non-existent. Having known several people, a son included, that have been incarcerated I have seen much indifference to inmate health concerns. Basic health care is everyone's right, regardless

One of the sad parts of this story is that she had to steal to eat. However, she should have gotten decent care. I have a relative in custody and the jail guards and staff do not have too much compassion, folks. The jail might want to settle now.

It sure is looking like our jails are starting to become death traps and abuse cases.The federal govt. needs to step in and take over jails who are starting to have problems like this so no more people become abuse victims or die in their hands.
